INTELLECTUAL PROPERTY RIGHTS POLICY

VIVIDROOTS LLC provides an internet-based platform that allows customers to purchase personalized products and home decor items. We strictly prohibit the use, creation, or sale of any content that infringes upon the intellectual property rights of third parties, including but not limited to copyrights, trademarks, and related rights.

If you believe that any content available on or through our Service infringes your intellectual property rights, we encourage you to notify us using the procedure outlined below.

PROCEDURE FOR REPORTING INTELLECTUAL PROPERTY INFRINGEMENT

It is our policy to:
1. Remove or disable access to any content that we believe in good faith infringes the intellectual property rights of others after receiving a valid notice.
2. Terminate access for repeat infringers.

If you believe that your intellectual property rights have been violated, please send a written notice including the following information:

- Identification of the copyrighted work or intellectual property that you claim has been infringed, including registration numbers if applicable;
- Identification of the content that you claim is infringing, including a description and its location on our website;
- Your contact information, including full name, mailing address, phone number, and email address;
- A statement that you have a good faith belief that the use of the material is not authorized by the intellectual property owner, its agent, or the law;
- A statement made under penalty of perjury that the information in your notice is accurate and that you are the owner or authorized to act on behalf of the owner;
- Your electronic or physical signature.

AFTER RECEIVING A VALID DMCA NOTICE

Once a valid notification is received, VIVIDROOTS LLC will:
- Remove or disable access to the allegedly infringing content;
- Notify the user who posted the content;
- Terminate accounts of repeat infringers when necessary.

COUNTER-NOTICE PROCEDURE

If you believe that content removed or disabled was not infringing, or that you have the right to use the content, you may submit a counter-notice including the following:

- Identification of the removed content and its previous location;
- A statement under penalty of perjury that the content was removed due to mistake or misidentification;
- Your full contact information;
- A statement that you consent to the jurisdiction of the Federal Court in your district (or the United States if outside the U.S.);
- Your electronic or physical signature.

Upon receiving a valid counter-notice, we may restore the content within 10–14 business days unless the original complainant files a legal action.

IMPORTANT NOTICE

Under Section 512(f) of the DMCA, any person who knowingly misrepresents that material is infringing may be subject to liability, including damages and legal fees.
